These Booking Terms and Conditions (“Terms”) are between Winkaffe Global LLC, a limited liability company doing business as Winkaffe Global Travel (“Agency”), and you, including all Travelers on the same booking (“you,” “your,” “yourself,” or “Traveler”).
These Terms become effective on your electronic or written signature, or on your payment authorization, and continue until terminated in writing by you or Agency.
Agency may update these Terms from time to time. The version that applies to your booking is the version you accepted at the time of your signature or payment authorization. Agency provides you a copy of that version at booking and will provide a further copy on request. Updates do not apply retroactively to a confirmed booking.
These Terms govern your booking of Travel Services. Agency’s website is governed separately by the Website Terms of Use at https://winkaffeglobaltravel.com/terms-of-use/, which is a different agreement and does not affect your booking.
These Terms are in addition to, and not in place of, any terms and conditions imposed by Suppliers providing your Travel Services. You agree to comply with both.
IMPORTANT: PART TWO OF THESE TERMS, THE ESCORTED GROUP TRAVEL ADDENDUM, APPLIES ONLY IF YOU ARE REGISTERED FOR AN ESCORTED GROUP TRAVEL EVENT HOSTED BY AGENCY, FOR EXAMPLE FAMILY CAMP OR AN ADULT-ONLY RETREAT. IF YOU ARE NOT REGISTERED FOR AN EVENT, ONLY PART ONE APPLIES. THESE TERMS CONTAIN WAIVERS OF LIABILITY, ASSUMPTION OF RISK, AND BINDING ARBITRATION. PLEASE READ THEM CAREFULLY.
Applies to all Agency bookings.
By your signature or payment authorization, you agree to these Terms, including all cancellation policies, on behalf of yourself and each Traveler on your booking.
You are the Lead Traveler and you represent all Travelers on your booking. You confirm that you have shared these Terms with all adult Travelers and obtained their agreement, and that you will deliver those confirmations to Agency on request.
You are responsible for booking, confirming, and paying for reservations far enough ahead of travel to ensure availability and to avoid late-booking fees and fare increases.
You are responsible for understanding these Terms. If any part is unclear, contact Agency in writing before accepting Booking Services or Travel Services and Agency will explain it.
For bookings under Part One, Agency provides Booking Services. Agency is not the source or supplier of the Travel Services you purchase.
For Events under Part Two, Agency also acts as the organizer of the Agency-provided program elements described in the Event Materials. See Part Two, Section E.
Agency may correct errors or omissions in pricing or booking information at any time.
Suppliers are independent companies operating under their own terms, conditions, and management. Your travel documentation identifies the Supplier responsible for each Travel Service. By paying for Travel Services, you consent to the use of those Suppliers.
All documentation, receipts, confirmations, and tickets issued are subject to the terms and conditions of each Supplier. Please read them carefully. You are responsible for understanding and complying with them, including paying all amounts when due and observing rules on availability, changes, and cancellation.
A violation of a Supplier’s terms may result in denied access to Travel Services, cancellation of reservations, and forfeiture of monies paid. If a violation by you results in fees or penalties to Agency, you agree to cover those actual costs.
Suppliers may require you to sign a liability waiver before providing their Travel Services.
Suppliers are not under Agency’s control and are not employees, agents, representatives, or affiliates of Agency. Agency is not responsible for a Supplier’s breach of contract, failure to comply with law, or negligent or willful acts, errors, or omissions, which may result in delay, inconvenience, cost, loss, damage, injury, or death.
If a Supplier declares bankruptcy, it is not obligated to transport you or to provide a refund. It may continue some or all Travel Services or stop operating entirely. Other Suppliers may, but need not, provide alternatives. Agency has no special knowledge of any Supplier’s financial condition and cannot provide refunds on behalf of a Supplier that has declared bankruptcy. Agency has no liability for recommending a trip credit or a refund.
Amounts you pay for Travel Services are remitted to the applicable Suppliers. Once remitted, refunds are governed by that Supplier’s terms and Agency cannot compel a refund. Amounts held and not yet remitted are handled in accordance with applicable seller of travel requirements.
All Supplier promotions, incentives, and offers are subject to Supplier availability and may change at any time without notice.
Quoted rates are based on the precise inclusions Agency provides to you in writing. Unless specifically itemized on your travel documentation, rates do not include:
Agency charges a planning fee for custom trips. The fee is set by the number of Travelers, the length of the trip, and its complexity.
Agency will communicate the applicable planning fee to you in writing before you pay anything. Planning fees are invoiced through Agency’s payment processor, and trip planning does not commence until that invoice is paid.
Planning fees compensate Agency for the time and expertise applied to your trip design and are non-refundable once planning has begun, whether or not you ultimately book Travel Services through Agency. Planning fees are separate from and in addition to Supplier costs.
Ticketing fees are invoiced at issuance. Hourly fees are invoiced when planning is complete. An invoice that remains unpaid before your travel date may be charged to the payment method on file. Document shipping charges are billed to you at cost.
Quotes are valid as of the date and time given. A quote in a currency other than U.S. Dollars is subject to exchange rate movement and to any foreign transaction fee your card issuer charges.
You authorize Agency to charge your credit card, debit card, or other payment method for the charges associated with your booking that you have approved.
Deposit requirements and final payment timing for Part One bookings are determined by each Supplier. Agency will communicate the applicable schedule to you in writing as part of your booking documentation, and you agree to comply with it. For Events, the schedule in the Event Materials applies instead.
A purchase of Travel Services is not complete until all deposits and other amounts due have been paid and processed and you receive a written booking confirmation.
Depending on your state of residence and the nature of your booking, your payments are collected either by Agency or by Coastline Travel Group, the registered seller of travel with which Agency is affiliated. Agency will tell you in writing, before you pay anything, which entity is collecting your payment and how to pay it. Either way, these Terms govern your booking and Agency remains your point of contact throughout.
Agency accepts payment by credit or debit card and by bank transfer through its payment processor. You will receive an invoice or a secure payment link. Bank transfer details are provided inside that payment page or in an invoice sent to you directly.
AGENCY WILL NEVER CHANGE ITS BANK TRANSFER DETAILS BY EMAIL, AND WILL NEVER ASK YOU TO SEND A PAYMENT TO AN ACCOUNT OTHER THAN THE ONE ON YOUR INVOICE.
If you receive any message appearing to come from Agency that changes payment details, adds urgency, or asks you to transfer funds to a different account, do not act on it. Telephone Agency on a number you already have and confirm before you send anything.
Agency will also not accept a change to your payment details by email. The account details on your invoice are the only details Agency will use for your booking.
Agency may quote and collect in a currency other than U.S. Dollars, including for Events. Where it does, the amount due is the amount stated in that currency, and the U.S. Dollar cost to you will depend on the exchange rate applied by your card issuer or bank on the date of each payment, plus any foreign transaction fee that issuer or bank charges. You bear those conversion costs and that exchange rate movement. Payments to Suppliers are converted at then-current rates.
Refunds are made in the currency in which the payment was received, and in the full amount of that currency received. Where you paid in a currency other than U.S. Dollars, the U.S. Dollar amount you receive back may be more or less than the U.S. Dollar amount you originally paid, because of exchange rate movement and any fee your card issuer or bank charges. Agency is not responsible for that difference.
Supplier prices may change before your booking is paid in full. If a Supplier or a government imposes an increase, tax, or fee after you have paid a deposit, Agency will notify you in writing, state the amount and the reason, and you may either approve the additional charge in writing or cancel the affected portion of your booking and receive a refund of all amounts you have paid that have not already been committed non-recoverably to Suppliers. Agency will not charge your payment method for any increase without your written approval of that specific amount.
If you do not make a payment by its due date, Suppliers may cancel your booking in whole or in part, which may cause deposits or previous payments to become non-refundable. You are responsible for Supplier price increases, fees, or penalties resulting from your late payment. Agency may cancel your booking if full payment is not received within a reasonable time.
If you request rebooking, Agency will assist with obtaining any refunds due, and may charge a non-refundable fee for that service, which Agency will tell you about before charging it.
You consent to Agency’s and Suppliers’ use of your personal information for the purpose of providing Booking Services and Travel Services. As part of booking, certain information may be conveyed to third parties to accommodate your travel, including names, dates of birth, passport numbers, travel dates, frequent flyer information, and payment details.
Agency maintains reasonable administrative and technical safeguards for the personal information you provide, and shares only the information a Supplier needs to deliver your Travel Services. Once transmitted, that Supplier’s handling of your information is governed by its own policies, and Agency is not responsible for a Supplier’s independent acts or omissions.
Agency retains your traveler profile and trip history indefinitely so that Agency can plan future travel for you, unless you ask Agency in writing to delete it, in which case Agency will do so except where a longer period is required by law or by Agency’s payment processor. Payment card information is retained only as long as Agency’s payment processor and applicable payment card rules and law require.

For any Traveler under 18, you confirm you are that Traveler’s parent or legal guardian and you consent on their behalf.
You agree to comply with Supplier terms and conditions regarding your Travel Services and changes to them, and to pay any applicable change or cancellation fees.
Change and cancellation fees for Part One bookings are determined by Suppliers. Agency does not impose its own cancellation fee structure for Part One bookings. Events are different, see Part Two, Section C. The applicable cancellation policy for each component of your travel will be communicated to you at the time of booking.
No refunds will apply to any cancelled, unused, or partially used Travel Service except as required by Supplier policy. Planning fees are non-refundable in all cases. Some hotels do not permit changes or cancellation at all.
Failure to travel or to show up for a reservation is a “no show.” No show penalties may equal the entire cost of travel, subject to Supplier and Agency policies.
Deliver any claim for a refund or adjustment to Agency in writing, with full details and proof of payment.
You may not be entitled to a refund if you change or cancel your travel plans after a booking is confirmed or paid. Refunds are subject to Supplier terms and conditions. Suppliers may decline refunds for cancellation due to actual, threatened, or feared terrorist events, political unrest, public health concerns, or similar circumstances. Please review Supplier terms carefully.
If you believe an amount was charged in error or a service was not delivered, you agree to notify Agency in writing first and to give Agency thirty (30) days to investigate and respond before pursuing another remedy. Nothing in these Terms limits any right you have under applicable law or under your card issuer’s rules.
Hotel accommodation is subject to availability at the time of reservation. Some hotels require non-refundable and non-transferable deposits to guarantee a booking, and Agency will tell you when that applies to your travel.
Amenities such as air conditioning, elevators, bed size, restaurants, bars, fitness facilities, and pools are not guaranteed to be available or operational during your stay. Reimbursement for a lack of amenities is the hotel’s responsibility. Agency may act as an intermediary but is not responsible for that reimbursement.
Most airlines treat a name change as a cancellation. Tickets are payable in full at the time of booking and, once purchased, may be non-refundable and non-exchangeable, subject to Supplier terms.
You are responsible for excess baggage fees and for confirming baggage allowances for all flights. International flights may have different requirements than domestic flights.
Agency is not responsible for loss, injury, accident, error, or omission including schedule changes, additional expenses, delays, and cancellations due to weather, equipment failure, or other matters beyond Agency’s control. You agree to comply with airline safety guidelines.
Seat assignments, baggage, carry-ons, meals, and other services may carry additional fees. Agency cannot guarantee specific or adjacent seats. Airlines may change aircraft and seat assignments at any time, and Agency is not responsible for those changes or for any resulting charges.
Travel insurance is required for all Travelers. It is arranged and paid for separately by you and is not included in your trip cost.
At minimum, Agency requires trip cancellation and interruption coverage insuring 100 percent of your prepaid, non-refundable trip cost.
Agency strongly recommends adding Cancel For Any Reason (CFAR) coverage, which can cover cancellation for reasons standard policies exclude. CFAR must generally be purchased within a short window after your initial trip deposit, reimburses a percentage rather than all of your trip cost, is subject to the insurer’s own conditions, and is not available to residents of every state, including New York and Washington. If you reside in a state where CFAR is unavailable, ask Agency about alternatives.
Agency also strongly recommends comprehensive coverage for emergency medical needs, evacuation, and trip delay.
Agency does not sell insurance and is not an insurance producer. Agency can refer you to providers and will assist you in submitting a claim. No description of any policy by Agency is a binding assurance about coverage. Coverage decisions belong to the insurer, and you hold Agency harmless for the denial of any claim for any reason.
You are responsible for any damage or loss caused by any Traveler on your booking, including minor children, whether negligent or otherwise. You are responsible for paying for that damage or loss, either directly to the Supplier or provider, or to Agency where Agency is liable for it. You indemnify Agency for any claim made against Agency relating to the acts, errors, or omissions of any Traveler on your booking, including attorney’s fees and legal costs.
All adult Travelers on the same booking are jointly and severally liable for amounts owed under this section. You authorize Agency to charge the payment method on file for amounts owed, after Agency notifies you in writing of the amount and the basis for it. Agency will provide the Supplier’s or host property’s assessment on request.
Agency is not responsible for costs relating to Traveler conduct or the removal of a Traveler from any Travel Service based on that Traveler’s negligence or willful misconduct.
Any Authorized Party may, in its sole discretion, refuse you a Travel Service, require you to leave it, or require you to disembark, if the Authorized Party reasonably believes:
If that determination is made, you may be left at any location where the mode of transport stops, you are solely responsible for your subsequent subsistence, accommodation, and transportation, and you forgo any right to a refund. No Authorized Party has liability relating to a Traveler’s acts, errors, or omissions.
“Authorized Party” means any Supplier or any of its agents, representatives, or sub-suppliers, including any ship operator, ship captain, tour operator, group leader, or crew member, and for Events, Agency and its Event leadership.
You are responsible at all times for your baggage and personal items, including items acquired during travel.
If you or any Traveler has a disability or special need that may require special services, additional support, or accommodation, please advise Agency in advance of booking, including any mobility or accessibility requirement.
If a Traveler cannot use their own wheelchair, mobility device, or medical equipment, rentals may be available and may carry additional charges. Airlines and other Suppliers may impose charges for additional baggage and may restrict the size of wheelchairs they can accommodate. A service animal or emotional support animal may require advance arrangements and documentation.
Countries outside the United States and Canada often apply different laws, standards, and accommodations for persons with disabilities. Destinations may have limited medical facilities, limited availability of prescription medications, and limited means to accommodate a disability or special need. Please consult your health provider before booking.
Agency will make all reasonable efforts to request assistance or arrange appropriate services or equipment, but is not responsible for a Supplier’s failure to meet a Traveler’s needs and expectations.
If any Traveler has a food allergy or a similar condition that may cause harm during travel, please advise Agency in advance of booking. Each affected Traveler acknowledges the possibility of an elevated risk of reaction, delay, or disruption, and has responsibility for their own due diligence relating to that condition before, during, and after travel.
If you engage in an activity that may involve risk of harm to any person, damage to property, or costs relating to that activity (“Risk Activity”), you are solely responsible for your decision to engage in it and for your involvement with it. You assume the risks and costs relating to Risk Activity, and you release Agency from claims relating to Risk Activity, subject to the Limitations of Liability below.
Risk Activity includes any activity that could reasonably be regarded as inherently dangerous or hazardous, or as having the potential to result in property damage or in injury, disability, illness, or death.
The Transportation Security Administration requires all airline passengers to provide Secure Flight Passenger Data, including full name as it appears on government-issued identification, date of birth, gender, and a redress number if available.
Travelers must present a REAL ID-compliant driver’s license or another form of identification TSA accepts. Requirements change. Check tsa.gov before you travel.
Names on all reservations and travel documents must match the name on that Traveler’s government-issued identification. You are responsible for any fee or expense incurred due to an incorrect name or a denial of travel resulting from incorrect or non-matching information.
All U.S. citizens traveling to or from an international destination must hold a valid passport, which most countries require to be valid for at least six months beyond the return date. You are responsible for confirming and obtaining in advance the travel documentation required by any Supplier and by any jurisdiction on your route, including requirements based on your citizenship, destination, and transit countries.
A minor Traveler aged 17 or under traveling without an adult, with a single parent, or with a non-parent adult may require additional documentation. No refund will be issued for costs or losses resulting from a failure to obtain or provide required travel documentation.
You are responsible for being familiar with the laws and rules governing travel to any country, for determining which documents you need, for acquiring them, and for ensuring your passport is valid to enter and exit each country. Agency may be able to assist on request, but Agency is not responsible for your failure to hold a valid passport, visa, or other required document.
Countries may restrict entry for persons with criminal records. You are responsible for understanding destination entry laws and for knowing whether anyone in your party has a criminal record. Agency does not inquire into criminal records, in the interests of privacy. Refusal of entry is not a justification for cancellation of Travel Services or for a refund.
You are solely responsible for being aware of health requirements, entry restrictions, and travel advisories that apply to your travel, and you confirm you have reviewed current guidance from the U.S. Centers for Disease Control and Prevention and the U.S. Department of State.
Countries may require testing, vaccination documentation, or quarantine on entry or return, and screening procedures may apply at airports and in public areas. Immigration restrictions may be introduced before or during travel that affect your ability to enter or leave a destination. Testing and required documentation may have limited availability at your destination.
Current guidance is published at https://wwwnc.cdc.gov/travel/notices and https://travel.state.gov/content/travel/en/traveladvisories/traveladvisories.html. Guidance may change before, during, and after your travel. Neither Agency nor Suppliers are responsible for Traveler testing or documentation.
You understand the inherent risks of travel and you hold Agency harmless against travel restrictions, illness, Supplier cancellations, financial loss, quarantine rules, and measures imposed at airports or destinations, and against financial penalties or fees imposed by Suppliers for cancellations or postponements relating to an epidemic, pandemic, natural disaster, accident, or similar event.
You are responsible for knowing and complying with the laws of each jurisdiction you travel through regarding restricted products and materials, including animals and animal products, plants, fruit, vegetables, soil, cultural artifacts, alcohol, firearms and ammunition, knives and cutting instruments, weapons, and explosives.
You are also responsible for knowing and complying with laws regarding illegal drugs, substances, and paraphernalia, including prescription and over-the-counter products that are restricted in some jurisdictions and unrestricted in others (“Drugs”). Local law may require you to carry a prescription from a qualified physician. Possession or use of Drugs may result in immediate termination of Travel Services and in prosecution by government authorities.
Federal law prohibits all air passengers from bringing hazardous materials aboard aircraft in luggage or on their person. Violations can result in imprisonment of up to 10 years and significant fines under 49 U.S.C. 5124.
Examples include explosives, compressed gases, flammable fluids and solids, oxidizers, poisons, corrosives, radioactive materials, paints, lighter fluid, fireworks, tear gases, oxygen bottles, lithium batteries, and radiopharmaceuticals. Limited exceptions apply for small quantities of medical and toilet articles. Current restrictions are listed at https://www.tsa.gov/travel/security-screening/whatcanibring/all.
Some foreign airports require airlines to treat passenger cabins with insecticides before or during flights. The U.S. Department of Transportation lists those requirements at https://www.transportation.gov/airconsumer/spray. You are responsible for understanding and complying with all hazardous materials and insecticide requirements. Contact your airline regarding your itinerary and the applicable rules.
FOR BOOKINGS UNDER PART ONE, AGENCY ACTS AS AN AGENT OF SUPPLIERS AND HAS NO CONTROL OVER SUPPLIER ACTIVITIES, TRAVELER ACTIVITIES, OR THE ACTIVITIES OF ANY THIRD PARTY.
TRAVELER AGREES THAT AGENCY HAS NO LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING ANY LIABILITY FOR PROPERTY DAMAGE, PERSONAL HARM, PHYSICAL INJURY, OR DEATH RELATING TO:
IF, DESPITE THE ABOVE, TRAVELER IS AWARDED DAMAGES AGAINST AGENCY, SUCH DAMAGES WILL BE LIMITED TO THE TOTAL AMOUNT YOU PAID TO AGENCY FOR THE BOOKING OR EVENT GIVING RISE TO THE CLAIM.
NOTHING IN THESE TERMS LIMITS OR EXCLUDES ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY AGENCY’S OWN NEGLIGENCE, FOR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR FOR FRAUD. IF ANY LIMITATION IN THESE TERMS IS HELD UNENFORCEABLE, THE REMAINDER CONTINUES TO APPLY.
AGENCY’S OBLIGATIONS ARE AS STATED IN THESE TERMS. ALL OTHER REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, ARE EXCLUDED TO THE EXTENT PERMITTED BY LAW.
If a dispute arises between you and Agency relating to these Terms, the parties will first attempt to resolve it personally and in good faith. If the dispute is unresolved sixty (60) days after written notice of the dispute, it will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules then in effect.
A single arbitrator will decide the dispute. The seat of arbitration is Franklin County, Ohio, and Ohio law governs. At your election, the hearing may be held by videoconference or in the federal judicial district where you reside.
Filing, administrative, and arbitrator fees will be allocated as provided in the AAA Consumer Arbitration Rules. Each party otherwise bears its own attorney’s fees, unless applicable law provides otherwise.
The arbitrator has no authority to add parties, to award punitive damages, or to certify or preside over a class or representative proceeding. Questions about the scope, enforceability, or validity of this arbitration provision are for the arbitrator to decide.
Small claims. Either party may instead bring an individual claim in small claims court, if the claim qualifies.
No failure or delay in performing an obligation under these Terms is a breach if it arises from a force majeure or any cause beyond Agency’s reasonable and foreseeable control, including acts of God, flood, weather, fire, explosion, accident, war or threat of war, terrorism, sabotage, insurrection, riot, strike, civil disobedience, illness, epidemic, pandemic, quarantine, government intervention, and defects in machinery or vehicles (“force majeure”).
Agency is not liable for and will not provide a refund for a delay or non-performance caused by force majeure, except as provided in Part Two, Section C for Events. If a Supplier is affected by force majeure, it may vary or cancel any itinerary or arrangement without notice. If an accident occurs and you seek assistance from Agency, you are responsible financially and otherwise for all alternative travel arrangements.
You agree to present any claim against Agency in writing within thirty (30) days after your travel ends, and to commence any arbitration or proceeding within one (1) year after the event giving rise to the claim, except where a longer period is required by applicable law or where the claim involves personal injury to a Traveler.
Assignment. You may not assign any right or obligation under these Terms without Agency’s prior written consent, which will not be unreasonably withheld or delayed.
Waiver. No forbearance or delay in enforcing these Terms prejudices any right of you or Agency. No waiver of a right operates as a waiver of a subsequent right, and each right is cumulative.
Severability. If any part of these Terms is found unenforceable, that part will be enforced to the fullest extent permitted by law and the remainder remains in force.
Relationship of parties. These Terms do not create a partnership, joint venture, or employment relationship between you and Agency. You have no authority to bind Agency.
Notices. Notices under these Terms will be in writing and are deemed given when sent, receipt confirmed, to the receiving party’s email or other notice address.
Counterparts. These Terms may be signed or accepted electronically in more than one counterpart, each an original, together constituting a single instrument.
Governing law. These Terms are governed exclusively by the laws of Ohio, without regard to conflict-of-law provisions.
Entire agreement. These Terms, together with your booking confirmation, your signed payment authorization, and for an Event the Event Materials, are the entire agreement between you and Agency and supersede all prior agreements, written or oral, on the same subject matter. This includes any prior Winkaffe Global Travel client terms, advisor terms, or event-specific terms and conditions, all of which are superseded.
THIS PART TWO APPLIES ONLY IF YOU ARE REGISTERED FOR AN ESCORTED GROUP TRAVEL EVENT HOSTED BY AGENCY. IF YOU ARE NOT REGISTERED FOR AN EVENT, YOU MAY DISREGARD IT. IF YOU ARE, THE PROVISIONS BELOW APPLY IN ADDITION TO PART ONE, AND IN CASE OF CONFLICT WITH PART ONE, PART TWO CONTROLS FOR THAT EVENT.
This Part Two is the only addendum that applies to Events. Any prior event-specific terms and conditions, including the Family Camp Terms and Conditions dated 17 July 2026, are superseded.
Each Event has its own details, including its name, dates, location, host property, included activities, group size, host advisor, price, deposit and payment schedule, minimum participation number, release date, and confirmation date. Agency provides these in the Event Materials, which form part of these Terms for that Event.
Registration for an Event is confirmed only on all three of the following: submission of the Event registration form with a valid payment authorization, Agency’s written acceptance of your registration, and receipt of your deposit.
Your payment method is authorized when you apply and is charged only if Agency accepts your family. Nothing is charged unless and until you are accepted.
Event pricing is per family and depends on the accommodation you select, the number of Travelers in your family, and any additional accommodation or options you add. The Event Materials set out the starting price for each room type, the occupancy limit for each room type, and the price of each addition or reduction. Your confirmed price is stated in your registration confirmation.
Event pricing is all-inclusive of the items itemized in the Event Materials and cannot be broken down into individual component pricing.
Occupancy limits for each room type are stated in the Event Materials and cannot be exceeded. Travelers beyond a room’s occupancy limit require additional accommodation, priced as set out in the Event Materials.
One family per registration. Two or more families may not be combined on a single registration. Each family registers, is accepted, and pays separately. Families who want to travel together are welcome to say so on their applications.
Items not included in the Event package price, unless itemized in the Event Materials: airfare to and from the Event location, travel insurance, parking, incidentals such as room service and honor bar, optional add-on excursions, alcohol, childcare, personal spending, spa treatments, pre-trip or post-trip extensions, and anything not itemized as included.
Whether gratuities for Agency-coordinated staff are included is stated in the Event Materials for that Event.
The deposit amount, the number and amount of any installments, and all payment due dates are published in the Event Materials and restated in your registration confirmation.
The deposit must be paid by credit card. You may pay the balance by credit card or by bank transfer.
Where the Event Materials offer a discount for paying the balance in full by bank transfer, the amount of the discount, the deadline, and the method are stated there. A discount does not change the cancellation retention in Section C, which is calculated on the list price before any discount is applied.
Late payment may result in your place being released to another Traveler, as set out in Section C. The Event deposit and payment schedule supersedes the Part One “follows Supplier” deposit provision.
Your Event price is stated in euros, and that euro amount is what you owe. Each scheduled payment is charged to your payment method in U.S. Dollars, in an amount calculated from the euro amount due using the exchange rate in effect on the date that payment is charged.
Because exchange rates change between payment dates, the U.S. Dollar amount of each scheduled payment will differ, and your total in U.S. Dollars is not known in advance. Agency will notify you in advance of each scheduled payment. You may change your payment method at any time by contacting Agency.
If you cancel your registration, Agency retains a percentage of your list price, before any discount, according to the date Agency receives your cancellation in writing. The retention for each Event is stated in that Event’s materials. Unless the Event Materials state otherwise, the retention is:
Agency refunds the balance of what you have paid, in U.S. Dollars, against the payments you made. The retention is set by the date of your cancellation, not by the date or the method of your payments, so paying early or paying in full does not change it.
Any planning fees included in Event registration are non-refundable in all cases. If you are dismissed from the Event under Section D, no refund is due.
Because travel insurance is required, Agency will assist you in submitting a claim to your insurer for the amount you have forfeited, subject to the terms of your policy.
Name substitutions on an Event booking are not permitted after the booking is confirmed, except in Agency’s sole discretion.
Travel insurance is required for all Event participants. It is arranged and paid for separately by the Traveler and is not included in the Event package price. Refer to the Part One Travel Insurance section.
Agency may cancel an Event in its entirety for any reason, including insufficient participation, at any time prior to departure. If Agency cancels an Event in its entirety for reasons other than a Force Majeure Event, Agency will, at your election, either refund all payments you have made for the Event package, or issue a credit in that amount toward a future Winkaffe Global Travel trip.
That refund or credit is your sole and exclusive remedy for Agency’s cancellation, and Agency has no further liability to you, including for airfare, travel insurance premiums, or visa or passport fees.
Each Event is contingent on the minimum number of confirmed registrations stated in the Event Materials. Agency will confirm that the Event is proceeding, or notify you of cancellation for insufficient participation, no later than the confirmation date stated in the Event Materials.
Where minimum participation for an Event is measured by registrations paid in full, the Event Materials will state the final payment due date, the release date after which an unpaid place may be offered to another Traveler, and the confirmation date. Agency confirms or cancels the Event after final payment is due, which means you will have paid in full before Agency makes that decision. If Agency cancels for insufficient participation, every payment you have made is returned to you, or becomes a credit, at your election.
Agency may release a place that is not paid in full by the release date. Where you have initiated payment before the release date and can evidence it, Agency will not release your place for funds still in transit.
Agency reserves the right to modify the Event itinerary, dates, location, host property, or programmed activities for any reason, including supplier availability, safety, capacity, or operational necessity.
Agency may substitute Event components with components of comparable or better quality, and such a substitution does not entitle you to a refund or credit.
If Agency makes a material change to the host property or to a core program element identified in the Event Materials, and you do not accept the change, you may cancel your registration and Agency will refund the payments you have made, less any amounts already committed non-recoverably to Suppliers on your behalf. Agency will state that deduction to you in writing. This is your sole and exclusive remedy for a material change.
A “Force Majeure Event” means any circumstance beyond Agency’s reasonable control, including acts of God, natural disaster, fire, flood, extreme weather, wildfire, epidemic or pandemic, public health emergency, quarantine, war, terrorism, civil unrest, strike or labor dispute, government action, travel advisory, border closure or entry restriction, unavailability of the host property or a key supplier, or disruption of transportation or utilities.
Agency is not liable for any failure, delay, or modification in performance of an Event caused in whole or in part by a Force Majeure Event.
If a Force Majeure Event affects an Event, Agency may, in its sole discretion, either postpone or reschedule it, in which case all payments you have made will be applied to the rescheduled Event, or issue a credit toward a future Winkaffe Global Travel trip in the amount of payments made. Because an Event requires substantial non-recoverable prepayments to secure the host property, culinary, staffing, and other services, payments are otherwise non-refundable in a Force Majeure Event, and a postponement or credit is your sole and exclusive remedy. This is why travel insurance is required. Agency is not responsible for consequential or incidental costs you incur, including airfare, insurance premiums, or visa or passport fees.
Events are group experiences. Agency maintains zero tolerance for behavior that affects the peaceable enjoyment of other Travelers or the safety of participants, including children at Events that welcome families.
Agency maintains a zero tolerance policy for any form of discrimination, sexual harassment, or bullying, including discrimination based on sex, sexual orientation, gender identity, race, color, religion, national origin, ancestry, age, marital status, pregnancy, medical or physical condition, disability, or military or veteran status.
Agency investigates every report promptly. Agency determines the appropriate response in its reasonable discretion, which may include restriction from activities, removal from the Event without refund, or referral to local authorities. A Traveler removed from an Event for conduct Agency determines has occurred is not entitled to a refund.
Agency maintains a zero tolerance policy for drunkenness or disorderly conduct that affects the peaceable enjoyment of any other Traveler, contractor, or property employee. A threat of or actual physical violence results in immediate dismissal from the Event without refund.
Alcohol consumption is permitted only within the boundaries of local law and Agency’s published Event guidance. Travelers may not provide alcohol or controlled substances to a person under the legal age in that jurisdiction. A Traveler who consumes alcohol or another legal controlled substance does so assuming all risk, including injury or death, and waives claims against Agency for voluntary consumption. Possession or use of a substance that is illegal in the jurisdiction may result in immediate termination of participation, dismissal without refund, and any legal consequence imposed by local authorities.
For any Event that welcomes minors, parents and legal guardians are at all times responsible for the supervision, safety, and conduct of their minor children, except during the childcare and supervised children’s programming Agency provides.
Where Agency provides childcare or supervised children’s programming for an Event, the scope of that care, the supervision arrangements, and the activities covered are itemized in the Event Materials, and each parent or guardian signs a childcare agreement as part of registration. That signed agreement is the prior written agreement required by this section. Outside the care Agency provides and that agreement, children may not be left in the care of Agency staff, host property staff, or other Event Travelers.
Travelers and all members of their booking agree to comply with the rules, instructions, and safety protocols of the host property, the activity providers, and Agency’s Event leadership. Failure to comply may result in dismissal from a specific activity or from the Event as a whole.
For Events, Agency acts as the organizer of the Agency-provided program elements described in the Event Materials, and as agent for third-party Suppliers as to everything else. Agency remains responsible for its own acts and omissions in organizing and delivering the Agency-provided elements, subject to the Limitations of Liability in Part One.
By registering for an Event, you confirm that you and all members of your booking have carefully read the Event itinerary and selected an experience appropriate for each person’s abilities, do not have an impairment, disability, medical condition, or stage of pregnancy that would present a safety risk during the Event or any programmed activity, have consulted a personal physician as appropriate, and will immediately advise Agency if anyone in your party is unable to meet the safety requirements of an activity.
Event activities may include outdoor recreation, water activities, animal-encounter activities, hiking, biking, off-road vehicle activities, climbing or above-ground suspension activities, swimming, boating, wellness activities, and cultural immersion. Each Traveler voluntarily assumes the inherent risks of these activities, including risks of slipping, falling, collision, and exposure to wildlife, weather, water, and equipment failure, both foreseeable and unforeseeable.
Agency reserves the right to cancel, terminate, modify, or discontinue any activity, to restrict participation, or to remove a Traveler from an activity if Agency reasonably determines the Traveler cannot meet safety requirements or has failed to follow rules.
Independent activities. Activities you undertake during an Event that are not arranged or led by Agency are at your sole responsibility. Agency has no control over your safety during independent activities.
ON YOUR OWN BEHALF AND ON BEHALF OF ALL MEMBERS OF YOUR BOOKING, INCLUDING MINOR CHILDREN FOR WHOM YOU ARE THE LEGAL GUARDIAN, AND YOUR HEIRS, EXECUTORS, PERSONAL REPRESENTATIVES, ADMINISTRATORS, AND ASSIGNS, YOU RELEASE, WAIVE, DISCHARGE, COVENANT NOT TO SUE, AND HOLD HARMLESS AGENCY, ITS OWNERS, EMPLOYEES, CONTRACTORS, AGENTS, REPRESENTATIVES, SUCCESSORS, AND ASSIGNS (THE “RELEASED PARTIES”) FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, CAUSES OF ACTION, JUDGMENTS, COSTS, EXPENSES INCLUDING ATTORNEY’S FEES, AND DAMAGES ARISING OUT OF OR RELATED TO ANY LOSS, DAMAGE, OR INJURY SUSTAINED AS A RESULT OF VOLUNTARY PARTICIPATION IN THE EVENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
This release does not apply to liability that cannot be released under applicable law, including liability for death or personal injury caused by Agency’s own negligence, for gross negligence or willful misconduct, or for fraud.
You voluntarily assume responsibility for risks of loss, property damage, injury, illness, or death sustained by you or any member of your booking, including claims caused by your own actions or those of other Event Travelers. You agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, demand, judgment, or cost, including court costs and attorney’s fees, incurred as a result of your or any member of your booking’s participation in the Event, other than a loss caused by a Released Party’s own negligence or misconduct.
For an Event at a property Agency has reserved in whole or in part, Agency is responsible to the host property for the condition of the property during the Event.
You are responsible to Agency for any loss of or damage to the host property, its grounds, contents, equipment, vehicles, or animals caused by you or any member of your booking, including minor children, whether negligent or otherwise, and whether or not the host property charges Agency for it. All adult Travelers on the same booking are jointly and severally liable for amounts owed under this section.
You authorize Agency to charge the payment method on file for amounts assessed under this section, after Agency notifies you in writing of the amount and the basis for it. Agency will provide the host property’s assessment or invoice on request.
Agency may require a refundable damage deposit or a payment card authorization hold for an Event. Where Agency does, the amount and the release conditions are stated in the Event Materials.
Where loss or damage occurs in a shared or common area of an Event property and cannot reasonably be attributed to a particular booking, Agency may allocate the cost among all bookings in proportion to the number of Travelers in each booking.
Some Event activities are not suitable during pregnancy. Pregnancy is not a bar to registration.
A Traveler who is or will be at or beyond the 28th week of pregnancy on any date during the Event must provide Agency with written approval from her physician confirming she is fit to travel and to participate, no later than the date stated in the Event Materials. Agency may restrict any Traveler from specific activities for safety reasons at any stage of pregnancy.
Travelers who are pregnant are strongly encouraged to consult their physician before registering. Agency is not responsible for complications relating to pregnancy at any stage.
Events are held at specific locations on specific dates, and severe weather may affect those locations.
Before the Event. If a hurricane, evacuation order, wildfire, or other severe weather event is forecast or declared such that Agency reasonably determines the Event location will be materially affected, Agency may, in its sole discretion, cancel the Event, in which case the refund or credit election in Section C applies, postpone the Event to a later date, in which case the force majeure provision in Section C applies, or proceed with the Event as scheduled.
During the Event. If a severe weather event arises during an Event, Agency will follow the guidance of local authorities and make decisions on evacuation or shelter in place based on participant safety. Where a government-issued evacuation directive applies, additional expenses for early departure or relocation are your responsibility, and no refund will be provided for the unused portion of the Event. Travelers acknowledge their obligation to file timely claims under their travel insurance for covered losses.
ASSUMPTION OF RISK. YOU ACKNOWLEDGE THAT AN INHERENT RISK OF EXPOSURE TO COMMUNICABLE AND INFECTIOUS DISEASE EXISTS IN ANY GROUP SETTING, INCLUDING AN EVENT. YOU VOLUNTARILY ASSUME THE RISKS OF EXPOSURE FOR YOURSELF AND ALL MEMBERS OF YOUR BOOKING, INCLUDING MINOR CHILDREN, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
For any minor child registered under your booking, you confirm you are the natural or legal guardian and you assume that risk on their behalf, to the fullest extent permitted by applicable law.
Agency may require pre-Event testing, vaccination status disclosure, or other screening based on then-current guidance from the CDC, the WHO, or local health authorities. Refusal to comply with a required protocol may result in denial of participation without refund.
Agency, the host property, and activity providers are not responsible for Traveler testing, documentation, or accommodations related to an infectious disease.
Agency will make reasonable efforts to operate each Event as described in the Event Materials. Agency’s rights to modify an Event, and your remedies for a material change or an Agency cancellation, are set out in Section C.
If a Traveler elects to leave an Event in progress voluntarily, no refund will be provided, and that Traveler is solely responsible for all travel arrangements and costs from the point of departure.
Agency may photograph, film, or record Event activities for promotional, marketing, or operational purposes. By registering, you grant Agency the right to use images and recordings depicting you and the adult members of your booking in Agency’s marketing materials, website, social media, and other communications, without compensation. If you do not consent, notify Agency in writing before Event arrival. Agency will make reasonable efforts to exclude you, but cannot guarantee complete exclusion from group shots.
Minor children. Agency will not use an image or recording depicting an identifiable minor in marketing materials, on its website, or on social media without the separate written consent of that minor’s parent or guardian, given on the Event registration form.
BY REGISTERING FOR AN EVENT AND BY PAYING THE EVENT DEPOSIT, YOU CONFIRM ON BEHALF OF YOURSELF AND ALL MEMBERS OF YOUR BOOKING THAT:
